Alameda, State of California, described in Exhibit "A", attached <br />hereto and incorporated by reference herein and shown in the plat <br />attached as Exhibit "B" (the "Property"). <br /> <br /> 2. Assignment of Right to Purchase. City, at its sole op- <br />tion, may elect to assign the right to purchase described in Sec- <br />tion 1 herein to a nonprofit public benefit corporation. <br /> <br /> 3. Sanitary Sewer Easement. Owner agrees to grant to City <br />an easement for the installation, maintenance, and operation of a <br />sanitary sewer line across Owner's lands to serve the Property, <br />said line to follow an alignment as generally shown in Exhibit <br />"C" (Preliminary Alignment Sanitary Sewer Easement), attached <br />hereto and incorporated herein by this reference ("Sanitary Sewer <br />Easement"). City shall design and install said line at a depth <br />and with sufficient capacity to service by gravity flow all of <br />Owner's 92 acre property. In recognition of Owner's cooperation <br />in allowing said sanitary sewer line to cross Owner's property, <br />those lands of Owner remaining after the sale of the 17 acre <br />Property from the 92 acre lands of Owner (the "Remainder Parcel") <br />shall not be obligated nor required to pay for any on-site or <br />off-site sewer mains which will serve those lands except such <br />additional mains as may be required within the Remainder Parcel <br />itself. City agrees to relocate, at City's expense, the portion <br />of the sewer line crossing the Remainder Parcel if, at the time <br />of the Remainder Parcel's development, relocation is required to <br />place the sewer main within a street or public service easement <br />adjoining a street. <br /> <br /> - 2 - <br /> <br /> <br />
