Therefore, assuming Livermore adopts the increased fees on June 9, the City's Master Fee Schedule will be amended to reflect the proposed monthly charge noted above plus a 5% administration charge. As an example, the monthly sewer rate for asingle-family residential account in the Ruby Hill's area will be $41.70; inclusive of the administrative charge. Proposition 218 Notice and Protest Hearing In November 1996 the voters of California adopted Proposition 218. Proposition 218 requires the City to mail information regarding the proposed sewer fee increase to every property owner and utility customer within the Ruby Hill area; hold a protest hearing at least 45 days after the mailing of the information; and if a majority of the affected property owners and utility customers protest in writing the increase in the fee(s), the legislative body must reject the proposed fee increase. On April 15, 2008, the City mailed 846 notices to the property owners of the 820 utility accounts in the Ruby Hill community notifying them of the proposed sewer rate increase effective July 1, 2008. On April 19, 2008, Pleasanton published the Notice of Public Hearing (Notice) in the Valley Times regarding the protest hearing to be held on June 3, 2008 before the Pleasanton City Council. Also, included in the notice and in the mailed information were the instructions on how to protest the increase in writing to the City of Livermore City Council at its meeting on May 12, 2008 and again to the City of Pleasanton City Council at your meeting on June 3, 2008.
