3 <br />THE CITY OF <br />pL~E~S~4NTONo CITY COUNCIL AGENDA REPORT <br />1 <br />June 3, 2008 <br />City Attorney <br />TITLE: SUPPORT AND OPPOSITION TO PENDING STATE LEGISLATION <br />SUMMARY <br />Pending in the State Legislature are a number of bills that could affect cities. These <br />include a bill to apply the California redemption value to all plastic bottles in order to <br />reduce plastic litter, a bill that would mandate that public work construction contracts be <br />subject to binding arbitration, a bill that would absolve a contractor from responsibility in <br />reviewing plans and specifications and a bill that will clarify how density bonus laws are <br />applied. The League of California Cities has asked for cities to support and/or oppose <br />these various bills. This action would authorize the Mayor to send letters to the State <br />Legislature and/or the Governor (assuming passage by the Legislature) on these bills. <br />RECOMMENDATION <br />Authorize the Mayor to send letters of support and/or opposition to pending state <br />legislation concerning (a) plastic bottle recycling [support], (b) binding arbitration for <br />contract disputes [oppose], (c) public contracting requirements [oppose], (d) clarifying <br />density bonus laws [support]. <br />FINANCIAL STATEMENT <br />There is no financial impact in sending letters in support/opposition. If some of these <br />bills were to become law, there could be a negative fiscal impact on the city. <br />
