RIGHT TO ENTER AND CONSTRUCT <br /> <br /> APN 941-1301-048 <br /> Reynolds and Brown Property <br /> Pleasanton, California <br /> <br /> By signature below, the CITY OF PLEASANTON, or its designated <br />representative, is hereby authorized to enter the property <br />described by the plat attached. The Stage 1B construction of the <br />Mopyard Road Interchange Improvements will include the excavation <br />for and construction of a retaining wall and the accompanying <br />backfill and drainage. The Stage 1B improvements are within the <br />adjacent State of California right-of-way. (Select backfill will <br />remain on private property. This is included in a separate docu- <br />ment.) The Stage 1B Interchange Improvements have received con- <br />ceptual approval and are in the final design phase. Stage 1B <br />will not be constructed until the plans have been reviewed and <br />received final approval from Caltrans and the Cities of Pleasan- <br />ton and Dublin. <br /> <br /> Any fencing removal, landscaping/irrigation removal or ex- <br />cavation required will be replaced in kind and to its existing <br />condition prior to contract completion at no expense to the prop- <br />erty owner. The contractor will provide at least 48 hours notice <br />of the date on which he will begin work adjacent to and on the <br />subject property. <br /> <br /> The CITY OF PLEASANTON shall defend, indemnify, and hold <br />harmless the property owner signed below against any and all <br /> <br /> - 1 - <br /> <br /> <br />
