CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-197 <br /> <br /> RESOLUTION VACATING A PORTION OF ABBIE STREET <br /> <br />WHEREAS, on May 6, 1986, the City Council received a staff report <br /> recommending the vacation of a portion of the dedicated <br /> street right-of-way for Abbie Street, more particularly <br /> described on Exhibit "A" attached hereto and <br /> incorporated herein by this reference; and <br /> <br />WHEREAS, the street right-of-way was never used by the public due <br /> to the development pattern to the east of the subject <br /> parcel; and <br /> <br />WHEREAS, access shall not be cut off to any person's property <br /> which, prior to relocation, adjoined the street being <br /> vacated; and <br /> <br />WHEREAS, public convenience and necessity require the reservation <br /> of a ten foot easement for public service facilities and <br /> sidewalk purposes; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing that <br /> the street right-of-way was never used by the public in <br /> a manner meeting the requirements of Section 8330 of the <br /> Streets and Highways Code, a portion of the street <br /> right-of-way for Abbie Street described in Exhibit "A" <br /> is hereby vacated. <br /> <br />Section 2: That public service easement described in Exhibit "A" <br /> and shown on the attached map shall be reserved from the <br /> vacation of the street right-of-way and public service <br /> easement. <br /> <br />Section 3: That from and after the date the resolution is <br /> recorded, the street, highway, or public service <br /> easement vacated no longer constitutes a street, <br /> highway, or public service easement. <br /> <br />Section 4: The Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the office of <br /> the Alameda County Recorder upon its becoming effective. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
