CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 86-197 RESOLUTION VACATING A PORTION OF ABBIE STREET WHEREAS, on May 6, 1986, the City Council received a staff report recommending the vacation of a portion of the dedicated street right-of-way for Abbie Street, more particularly described on Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, the street right-of-way was never used by the public due to the development pattern to the east of the subject parcel; and WHEREAS, access shall not be cut off to any person's property which, prior to relocation, adjoined the street being vacated; and WHEREAS, public convenience and necessity require the reservation of a ten foot easement for public service facilities and sidewalk purposes; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing that the street right-of-way was never used by the public in a manner meeting the requirements of Section 8330 of the Streets and Highways Code, a portion of the street right-of-way for Abbie Street described in Exhibit "A" is hereby vacated. Section 2: That public service easement described in Exhibit "A" and shown on the attached map shall be reserved from the vacation of the street right-of-way and public service easement. Section 3: That from and after the date the resolution is recorded, the street, highway, or public service easement vacated no longer constitutes a street, highway, or public service easement. Section 4: The Clerk shall cause a certified copy of this resolution of vacation to be recorded in the office of the Alameda County Recorder upon its becoming effective. Section 5: This resolution shall become effective immediately upon its passage and adoption.
