Any party or successor in <br />interest may change the foregoing address by giving notice of a <br />new address to each other party in the manner herein provided. <br />Notice shall be considered received two (2) days after the time <br />of mailing. <br /> <br />XII. SUCCESSORS IN INTEREST <br /> <br /> This agreement shall run with the land and be binding upon <br />any and all heirs, assigns, and successors in interest of <br />Developer having an interest in the property described in Exhibit <br />"A". Upon subdivision of the project site, the obligations under <br />this agreement of each parcel of the subdivision shall be limited <br />to a pro rata amount of the total costs -- whether by assessment <br />district or other funding mechanisms -- for all of said property <br />as the acreage of the parcel bears to the total acreage of the <br />project site. <br /> <br />XIII. RECORDATION <br /> <br /> This agreement shall be recorded in the office of the County <br />Recorder of Alameda County.
