Box 520 <br /> Pleasanton, CA 94566 <br /> <br /> MITIGATION MEASURES AGREEMENT <br /> (Pimlico Plaza Associates) <br /> <br /> THIS AGREEMENT, made and entered into on the 6th day of May, <br />1986, by and between PIMLICO PLAZA ASSOCIATES, a California <br />partnership (hereinafter referred to as "Developer") and the CITY <br />OF PLEASANTON, a municipal corporation, (hereinafter referred to <br />as "City'). The City and Developer agree as set forth below. <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, Developer is the owner of real property as community <br />property in the City of Pleasanton described in Exhibit "A", <br />attached to this agreement and made a part of it by reference, <br />which consists of Parcel 1 of Parcel Map 4648, an approximately <br />1.986 acre parcel (hereinafter referred to as the "project <br />site"); and <br /> <br /> WHEREAS, Developer has received development plan approval for <br />PUD-80-15-2D by Ordinance No. 1232 of the city of Pleasanton <br />which would allow a two building, 29,740 sq. ft. retail <br />commercial site on the project site; and <br /> <br /> WHEREAS, prior to approving the development plan, City <br />adopted a Mitigated Negative Declaration in which certain <br />measures were mutually agreed upon by City and Developer so as to <br />avoid potential significant adverse impacts; and <br /> <br /> - 1 - <br /> <br /> <br />
