AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into this day of <br /> <br />April, 1986, by and between THE PRUDENTIAL INSURANCE COMPANY OF <br />AMERICA, a New Jersey corporation (hereinafter referred to as <br />"Prudential"), and the CITY OF PLEASANTON, a municipal corpora- <br />tion (hereinafter referred to as "City"). <br /> <br /> WHEREAS, a portion of the Southern Pacific Railroad right-of- <br />way through the City of Pleasanton has been abandoned and sold to <br />adjacent land owners in North Pleasanton; and <br /> <br /> WHEREAS, in order for proper roadway improvements for <br />Stoneridge Drive extension and as a condition of the sale of the <br />railroad right-of-way, Southern Pacific required the railroad <br />bridge over the Arroyo Mocho to be removed and the high pressure <br />petroleum pipeline, presently attached to the trestle, to be <br />relocated; and <br /> <br /> WHEREAS, the North Pleasanton Improvement District No. 1982-4 <br />was formed to fund various roadway and utility projects; and <br /> <br /> WHEREAS, the parties contemplated that the bridge removal and <br />pipeline relocation would be included in projects to be funded by <br />the assessment district; and <br /> <br />WHEREAS, Prudential is the owner of lands within the area to be <br />served by the Southern Pacific bridge removal and pipeline <br />relocati0n. Prudential has volunteered to provide funding in <br /> <br /> - 1 - <br /> <br /> <br />
