CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-176 <br /> <br /> A RESOLUTION OF NECESSITY TO ACQUIRE BY EMINENT DOMAIN <br /> PROPERTY NEEDED FOR THE IMPROVEMENTS AT THE HOPYARD <br /> ROAD/I-580 INTERCHANGE (WARREN AVENUE ASSOCIATES <br /> PROPERTY) <br /> <br /> WHEREAS, in analyzing the traffic circulation system necessary to <br /> accommodate the planned development in the North <br /> Pleasanton area, the City of Pleasanton has focused <br /> attention on the configuration of the Hopyard Road/I-580 <br /> interchange as the initial interchange to be <br /> reconstructed; and <br /> <br />WHEREAS, implementation of the improvements at the Hopyard <br /> Road/I-580 interchange requires acquisition of private <br /> property; and <br /> <br />WHEREAS, a detailed plan has been prepared by the City which will <br /> allow temporary construction easement in order to <br /> minimize impacts upon existing uses; and <br /> <br />WHEREAS, notice was given pursuant to Section 1245.235 of the <br /> Code of Civil Procedure of the State of California and a <br /> hearing was held at which time persons affected had an <br /> opportunity to appear and be heard; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council finds that, pursuant to Section <br /> 37350.5 of the Government Code of the State of <br /> California authorizing the City of Pleasanton to acquire <br /> property by eminent domain, all that land described in <br /> Exhibit A, attached hereto and including a portion of <br /> Assessor's Parcel No. 941-1301-15 (Warren Avenue <br /> Associates), is necessary for public use as a public <br /> street. <br /> <br />Section 2: The City Council declares that, with respect to the <br /> proposed improvements at the Hopyard Road/I-580 <br /> interchange, it has found and determined that: <br /> <br /> (a) the public interest and necessity require the <br /> proposed project; <br /> <br /> (b) the proposed project is planned and located in the <br /> manner that will be most compatible with the <br /> greatest public good and the least private injury; <br /> and <br /> <br /> <br />
