CITY COUNCIL OF THE CITY OF PLE~SANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 86-175 A RESOLUTION OF NECESSITY TO ACQUIRE BY EMINENT DOMAIN PROPERTY NEEDED FOR THE IMPROVEMENTS AT THE HOPYARD ROAD/I-580 INTERCHANGE (FRUMENTI DEVELOPMENT CORPORATION PROPERTY) WHEREAS, in analyzing the traffic circulation system necessary to accommodate the planned development in the North Pleasanton area, the City of pleasanton has focused attention on the configuration of the Hopyard Road/I-580 interchange as the initial interchange to be reconstructed; and WHEREAS, implementation of the improvements at the Hopyard Road/I-580 interchange requires acquisition of private property; and WHEREAS, a detailed plan has been prepared by the City which will allow temporary construction easement in order to minimize impacts upon existing uses; and WHEREAS, notice was given pursuant to Section 1245.235 of the Code of Civil Procedure of the State of California and a hearing was held at which time persons affected had an opportunity to appear and be heard; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council finds that, pursuant to Section 37350.5 of the Government Code of the State of California authorizing the City of Pleasanton to acquire property by eminent domain, all that land described in Exhibit A, attached hereto and including a portion of Assessor's Parcel No. 941-1301-17 ~Frumenti Development corporation), is necessary for public use as a public street. Section 2: The City Council declares that, with respect to t~e proposed improvements at the Hopyard Road/I-580 interchange, it has found and determined that: (a) the public interest and necessity require the proposed project; (b) the proposed project is planned and located in the manner that will be most compatible with the greatest public good and the least private injury; and - 1 -
