RESOLUTION NO. 08-190 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />DENYING THE APPEAL OF CASE PAP-120, THEREBY UPHOLDING THE <br />PLANNING COMMISSION'S APPROVAL OF THE APPLICATION OF AMAN AND <br />TEE BAWA FOR DESIGN REVIEW, AS FILED UNDER CASE PADR-1762 <br />WHEREAS, Aman and Tee Bawa have applied for administrative design review <br />approval to construct an approximately 700-square-foot, detached second unit with an <br />approximately 250-square-foot covered porch at the property located at 2632 Ingrid Court; <br />and <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development -Low <br />Density Residential) District; and <br />WHEREAS, on January 22, 2008, the Zoning Administrator approved the <br />application for administrative design review; and <br />WHEREAS, on February 26, 2008, Xin Chen and Frank Nguyen filed an appeal of <br />the Zoning Administrator's decision to the Planning Commission; and <br />WHEREAS, at its meeting of March 12, 2008, the Planning Commission, after <br />having considered all public testimony, relevant exhibits, and recommendations of City <br />staff concerning this application, denied the appeal, thereby upholding the decision of the <br />Zoning Administrator; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Xin Chen <br />submitted an appeal to the City Council of the decision of the Planning Commission; and <br />WHEREAS, at its meeting of May 6, 2008, the City Council received a report from <br />the Director of Planning and Community Development, together with a copy of the staff <br />report to the Planning Commission, regarding this matter; and <br />WHEREAS, the City Council held a public hearing on May 6, 2008, at which time <br />the appellant and any other member of the public were offered an opportunity to present <br />evidence regrading this appeal; and <br />WHEREAS, actions of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act (CEQA) Guidelines, Class 3, <br />Section 15303(a), "New Construction or Conversion of Small Structures"; and <br />WHEREAS, after receiving public testimony and review of the materials <br />presented, the City Council determined that the proposed design is appropriate for the <br />site, will not detrimentally affect the surrounding properties, and consistent with the <br />zoning regulations for the zoning district of the property. <br />
