b. Closure of Crossing. Upon completion of the Valley <br />Avenue Extension Project so that there is unobstructed public <br />street access from Stanley Boulevard to the Kaiser Property <br />suitable for and available for use by gravel trucks typically <br />used by Kaiser, its customers, and independent truck companies <br />serving its customers, then Kaiser shall cease using the Kaiser <br />Private Crossing. Kaiser shall not again commence vehicular or <br />any other use of the Kaiser Private Crossing so long as such ac- <br />cess over public streets from Stanley Boulevard to the Kaiser <br />Property remains available. <br /> <br /> 4. Grant of License to E1 Charro Route. <br /> <br /> a. "El Charro Route" Defined. When used in this <br />Agreement, the term "El Charro Route" shall mean that presently <br />existing road which begins at the easterly terminus of Busch Road <br />where it enters the Kaiser Property and extending as close to the <br />E1 Charro Interchange of 1-580 as Kaiser has the right to convey <br />a right of passage or any road which is substantially equivalent <br />to that presently existing road in terms of safety and economic <br />impact. <br /> <br /> b. "Qualifying Properties". When used in this Agree- <br />ment, the term "Qualifying Properties" shall be those properties <br />located north of the Western Pacific Railroad main line which <br />participate in the Assessment District. <br /> <br /> c. License. From and after the date of the closure of <br />the Kaiser Private Crossing referred to in Paragraph 3b, above, <br />Kaiser agrees to grant to the owners, tenants and customers of <br /> <br /> - 4 - <br /> <br /> <br />
