EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PADR-1698, Scott and Laurie Smith <br />3496 Whitehall Court <br />March 4, 2008 <br />The proposed development covered by this approval shall conform substantially to <br />Exhibit A, dated "Received, April 27, 2007," on file with the Planning Department, except <br />as modified by the following conditions of approval. Minor changes to the proposal may <br />be approved by the Planning Director if found to be in substantial compliance with the <br />proposal. <br />2. This design approval shall lapse and shall be void sixty (60) days following the effective <br />date of project approval unless prior to the expiration of 60 days, a building permit for the <br />additions for PADR-1698 is issued. If a building permit is issued as provided in the <br />preceding sentence, this design review approval shall lapse and shall be void six months <br />after the building permit is issued unless the applicant has obtained a building final and <br />has completed all exterior work related to PADR-422 and PADR-1698 as provided in <br />Condition No. 5. <br />3. No design review approval or building permits shall be extended. Should the design <br />review approval or building permit referenced in Condition No. 2 lapse, the additions <br />shall be removed/demolished in their entirety within 60 days of the lapsing. <br />4. If this design review approval lapses, if the building permit for the additions lapses, or if <br />Condition No. 5 is not satisfied, the City shall immediately initiate abatement procedures <br />to have the additions removed. <br />5. Within six months from the date the building permit is issued, the applicant shall obtain a <br />building final and complete all exterior and interior work related to PADR-422 (2001 <br />project) and PADR-1698, including, but not limited to, all plumbing, electrical, swimming <br />pool, landscaping and irrigation, and all flat work. A final inspection by the Planning <br />Department is required prior to the final inspection by the Building and Safety Division. <br />6. All site improvements and construction activities shall be limited to the hours of 8:00 a.m. <br />to 5:00 p.m., Monday through Saturday, except that no exterior work shall occur on <br />Saturday. In addition, no construction shall be allowed on Federal Holidays. If <br />complaints are received regarding the Saturday interior-only construction hours, the <br />Planning Director may modify or revoke the Saturday interior-only construction hours. <br />The Planning Director may allow earlier "start-times" for specific construction activities <br />(e.g., concrete-foundation/floor pouring), if it can be demonstrated to the satisfaction of <br />the Planning Director that the construction noise and construction traffic noise will not <br />affect nearby residents. All construction equipment must meet DMV noise standards <br />and shall be equipped with muffling devices. <br />7. The window(s) facing the Morgan's shall be non-reflective glass. This requirement shall <br />be stated in the construction drawings submitted for plan check and building permit. <br />
