RESOLUTION NO. 08-174 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />DENYING THE APPEAL OF CASE PAP-110, THEREBY UPHOLDING THE <br />PLANNING COMMISSION APPROVAL OF THE APPLICATION OF SCOTT AND <br />LAURIE SMITH FOR ADMINISTRATIVE DESIGN REVIEW APPROVAL, AS FILED <br />UNDER CASE PADR-1698 <br />WHEREAS, Scott and Laurie Smith have applied for an administrative design review <br />approval for the construction of an approximately 64-square-foot single-story addition on the left <br />side and an approximately 273-square-foot second-story addition on the right side, of the existing <br />two-story residence located at 3496 Whitehall Court; and <br />WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) District; <br />and <br />WHEREAS, on July 20, 2007, the Zoning Administrator approved the application, and <br />within the time specified by the Pleasanton Municipal Code, Dennis Long, Robert Leete, and <br />Frank Morgan, Jr. submitted an appeal to the decision of the Zoning Administrator; and <br />WHEREAS, at its meeting of September 26, 2007, the Planning Commission, after <br />having considered all public testimony, relevant exhibits, and recommendations of City staff <br />concerning the application, denied the appeal, thereby upholding the decision of the Zoning <br />Administrator; and <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the .same <br />appellants submitted an appeal to the decision of the Planning Commission; and <br />WHEREAS, at its meeting of March 4, 2008, the City Council received a report from the <br />Director of Planning and Community Development, together with a copy of the staff report to the <br />Planning Commission, regarding this matter; and <br />WHEREAS, the City Council held a public hearing on March 4, 2008, at which time the <br />appellants, the applicants, and other members of the public were offered an opportunity to <br />present evidence regarding this appeal; and <br />WHEREAS, after a review of the materials presented, the City Council determined that <br />the proposed project, as conditioned, is appropriate for the site and is consistent with the zoning <br />regulations of the zoning district of the property. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br />SECTION 1. Denies the appeal, Case PAP-110, thereby upholding the Planning <br />Commission's approval of Case PADR-1698, the application of Scott and Laurie Smith for an <br />administrative design review approval for the construction of an approximately 64-square-foot <br />single-story addition on the left side, and an approximately 273-square-foot second-story <br />addition on the right side, of the existing two-story residence located at 3496 Whitehall Court, <br />subject to the conditions shown on Exhibit B, attached hereto and made a part of this case by <br />reference. <br />
