RESOLUTION NO. 08-188 <br />A RESOLUTION AUTHORIZING THE FILING OF CLAIMS WITH THE METROPOLITAN <br />TRANSPORTATION COMMISSION (MTC) FOR ALLOCATION OF TRANSPORTATION <br />DEVELOPMENT ACT FUNDS, AND WITH THE ALAMEDA COUNTY TRANSPORTATION <br />IMPROVEMENT AUTHORITY (ACTIA) FOR MEASURE B FUNDS FOR FISCAL YEAR <br />2008/09 <br />WHEREAS, the Transportation Development Act (TDA), as amended (Public Utilities <br />Code Section 99200, et Seq.), provides for the disbursement of funds from the Local Transportation <br />Fund of the County of Alameda for use by eligible claimants for the purpose of community transit <br />services to local residents; and <br />WHEREAS, pursuant to the provisions of the TDA, as amended, and pursuant to the <br />applicable rules and regulations hereunder (21 California Administrative Code, Sections 6600, et <br />seq.), a prospective claimant wishing to receive an allocation from the Local Transportation Fund <br />shall file its claim with the Metropolitan Transportation Commission (MTC); and <br />WHEREAS, Alameda County Measure B provides for the distribution of funds from local <br />dedicated sales tax to provide special transportation for seniors and persons with disabilities; and <br />WHEREAS, pursuant to the provisions of Measure B, a prospective claimant wishing to <br />receive an allocation from Alameda County shall file its claim with the Alameda County <br />Transportation Improvement Authority (ACTIA); and <br />WHEREAS, the claim proposes to continue a current program utilizing existing equipment, <br />manpower, and routes, and proposes minor additional services and is, therefore, considered <br />exempt from the requirements of the California Environment Quality Act (CEQA); and <br />WHEREAS, TDA funds from the Local Transportation Fund of Alameda County and <br />Measure B funds will be required by the Pleasanton Paratransit Service in Fiscal Year 2008/09 for <br />community transit services. <br />NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />SECTION 1: Authorizes James W. Wolfe, Director of Parks and Community Services, to <br />execute and file appropriate claims pursuant to the terms of the Transportation Development <br />Act and Alameda County Measure B, as amended, and pursuant to applicable rules and <br />regulations promulgated thereunder, together with all necessary supporting documents, with <br />the MTC, ACTIA and the Alameda County Board of Supervisors for an allocation of TDA <br />and Measure B funds for Fiscal Year 2008/09. <br />SECTION 2: A copy of this Resolution will be transmitted to the MTC, ACTIA, and the <br />Alameda County Board of Supervisors in conjunction with the filing of claims, and the MTC <br />and ACTIA will be requested to grant the allocations of funds as specified herein. <br />SECTION 3: This Resolution shall become effective immediately upon its passage and <br />adoption. <br />
