DRAFT <br />Chair Blank suggested that a drainage and grading plan be required and that the retaining wall <br />material be subject to the review and approval of the Building and Safety Division. He indicated <br />that he was surprised by the amount of space desired by the applicant between the house and the <br />pool and that he would like to see more of setback; however, he would support the ten-foot rear <br />yard setback especially since the Bessos were amenable to it. He indicated that he agreed with <br />the majority of the Commission with respect to aten-foot setback for the hot tub. He noted that <br />the decision would not make everyone happy but that this was part of trying to figure out the best <br />way to work through this. <br />Commissioner Pearce moved to recommend approval to the City Council of <br />Case PUD-99-O1-OSM, subject to the conditions of approval as listed in Exhibit B of the <br />staff report with the modifications that Condition No. 3 include the language for Option 2 <br />regarding reducing the side yard setback from ten feet to five feet and the rear yard <br />setback from 20 feet to 10 feet and the addition of a condition that the applicant submit a <br />drainage and grading plan prior to the issuance of a building permit. <br />Ms. Decker proposed the following language for the new condition as follows: "The applicant <br />shall submit a grading and drainage plan that provides detailed information regarding materials <br />to be used to retain and provide positive drainage, subject to the review and approval of the <br />Director of Planning and Community Development prior to the issuance of a building permit." <br />Commissioner Fox seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Blank, Fox, Narum, Olson, and Pearce. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None. <br />Resolution No. PC-2008-17 recommending approval to the City Council of <br />Case PUD-91-02-OSM was entered and adopted as motioned. <br />Ms. Decker noted that as a major modification, this item would automatically come before the <br />City Council and that no appeal was required. <br />DRAFT EXCERPTS: PLANNING COMMISSION MINUTES, 4-9-2008 Page 8 of 8 <br />
