At <br />that time it was my understanding that you had met with the architectural review committee from our <br />association and that they presented to you a proposal for the city to modify the setbacks from the current <br />15 feet. In recent correspondence from Mr. Spencer he has stated that these new setbacks were in fact <br />"proposed" by the city and not by the Lemoines ACC group that met with you. I would appreciate if you <br />could clarify the city's position on the current and "proposed" setbacks and what procedures we must follow <br />if the HOA in fact approved filing for the setback modification. <br />I also wanted to let you know that on the issue between Mr Spencer and his proposed swimming pool/ <br />setback to our yard and the suggestion of mediation made by the city; we have offered to split the cost <br />with the Spencer family but I also was informed today that he will not mediate until the PUD is amended to <br />the new setbacks which kind of puts us back to square one. <br />Look forward to hearing from you on these issues. <br />Thank you <br />Terry Besso <br />1/10/2008 <br />
