Robin Giffin
From: Terry Besso
Sent: Wednesday, July 25, 2007 12:22 PM
To: Steven Spencer
Cc: Nicole Norris; Kryssa Cooper; Robin Giffin; Russ Berry
Subject: RE: Set Back Variance
Steve,
Just to get everything on the record and this will be the last time we will have
communication concerning this subject matter.
1-During one of the meetings at Kryssa Cooper's house a non dimensioned drawing was
presented on an 8.5 x 11 piece of paper. I remember that it was done in color and was not
dimensioned as were the prints presented to the city by you. I briefly looked at it and
said the design looked good.
2-I have no authority to approve the plans as that is the responsibility of our ACC board
3-After reviewing the architectural plans at the city planners desk with Robin Giffin we
saw the details that to my recollection were not on the colored drawing. We are entitled
to have an opinion and we are also entitled to change our opinions. Judy is my equal
partner and at the city we were not happy with the setback of just 5' from our property
line. Your pool design actually puts it physically closer by 5' to our house than yours.
We are asking that the pool be moved closer to your home and that all the water falls,
jets etc. be located on the opposite side. That is why we asked for a compromise from you.
4-After we met with you on Tuesday evening you were not willing to compromise the layout
of your pool. To reach an agreement both parties must be willing to change.
5-Our portable hot tub actually borders the Barnish and Coqueil property line and is on a
diagonal to the back corner of your yard. The Barnish family have voiced no objection to
its location.
6-Your comment last evening about my water fall not being up to code was not appreciated.
It was built to generate little to no sound as the water is intended to have a dribble
effect over the grooved horizontal surfaces .
7-You have stated repeatedly that I never got my plans approved by the~ACC and by the
city. I have a letter giving approval by DeNova. Ms Cooper can give you a copy if you so
request. I also presented the plans to the city in September of 2005. As Robin Giffin was
out for an extended period of time and I was directed to Mr. Wes Yost, Development
Services Manager. Our plans were given to him to approve for the GRAD.
He then proceeded to have the city landscape architect Mike Fulford review the plans. Both
gentlemen came back with a verbal approval.
Remember, I did get approval for my backyard, did you?
8- Future communication will be through the city planner Robin Giffin concerning this
matter
From: Steven Spencer [mailto:spencer.steven@gmail.com]
Sent: Tuesday, July 24, 2007 8:25 PM
To: Terry Besso
Cc: Nicole Norris; Kryssa Cooper
Subject: Re: Set Back Variance
Terry,
My apologies for intruding on your time this evening, and I'm very sorry and disappointed
that we could not find any common ground...
Steve
On 7/24/07, Steven Spencer <spencer.steven@gmail.com> wrote:
> Terry,
1
