Natalie Amos <br />From: Steven Spencer , <br />Sent: Monday, February 11, 2008 9:09 PM <br />To: Natalie Amos <br />Subject: Re: Lemoine Ranch Estates -site visits <br />Natalie, <br />My apologies for not being able to meet you today as you surveyed the neighborhood... <br />after speaking with my wife this evening, I wanted touch base with you regarding the <br />issues still facing the neighborhood... <br />I have been reasonable and willing to make this a win win situation for all, however this <br />situation is now approaching a one year anniversary, and I think you would agree that this <br />is an unreasonable amount of time, energy and effort expended on everyone's part... <br />In regards to the mediation with the Besso's, I have always stated that I would mediate in <br />good faith and another offer to mediate was extended by Russ and Kryssa at the beginning <br />of the year, I again reiterated my willingness to do so, as I did with you last spring... <br />Terry has subsequently refused... The Besso's delaying tactics are a distraction and a <br />disruption to the neighborhood and the ill will that has been generated needs to be ended <br />as quickly as possible for the good of all... <br />I think it is time to present the 'set backs' to the neighborhood in general and the <br />Besso's can choose to openly object to the global neighborhood setbacks initiatives or <br />not... at the last HOA meeting, it was 11 households for and one abstained. Just for the <br />record this is not just about me, we have a new family that has recently moved into the <br />neighborhood and their rear yard was never improved by the original owner. I'm sure they <br />would like to make some improvements this spring as I would, it is time take steps and <br />actions towards this end not further delays. <br />My assessment of the Besso's action and comments are that they are maneuvering to exclude <br />my home from the global neighborhood setbacks modifications... and that the restrictions <br />in place by the current PUD remain in effect for my home only... both of which I deem <br />unreasonable. This past year the Besso's and others have been afforded the quiet enjoyment <br />of their home and the improvements which they have made to their property as granted by <br />the City of which many are not compliant with the current PUD restrictions... I think you <br />would agree I have not been granted equal treatment by the City to date... <br />In summary, if the worst case scenario is that we go before the Planning Commission and <br />City Council and plead our case, I think we would be granted our request considering the <br />current precedents and the backing of all my other neighbors... <br />Please reply as soon as possible or call me to discuss the issue further, thanks. <br />Regards, <br />Steven J.
