ATTACHMENT 2 <br />EXHIBIT B <br />Draft Conditions of Approval <br />PUD-99-O1-05M /Swimming Pool <br />80310ak Creek Drive <br />The swimming pool and related site improvements shall be substantially as shown on the <br />plans, Exhibit "A", dated "Received June 18, 2007", on file at the Planning Department, <br />except as modified by the following conditions of approval. Minor changes to the plans <br />may be allowed subject to the review and approval of the Planning Director if found to be <br />in substantial conformance to the approved exhibits. <br />2. Except as modified by the following conditions of approval, all conditions of Cases PUD- <br />99-0 l through PUD-99-1-04M shall remain in full force and effect. <br />3. Existing condition of approval #8 of Case PUD-99-O1 shall apply to 8031 Oak <br />Creek Drive (lot 8) only and does not apply to the entire development. As <br />modified by the Planning Commissions recommended option below, the condition <br />shall be modified to read as follows: <br />"8. The minimum setback regulations for all main structures, Class I, and Class II <br />accessory structures on lots 1-12 shall be as follows: <br />Front Side Street Side Rear <br />Yard Yard Yard Yard <br />Lots 1,2, & 10 150' ab 25'a 25'a 20'a <br />Lots 3-9, 1 1, & 12 23' aca ~$sa 15' as ~A-aa <br />x'aa x'aa <br />OPTION 1: Allow the applicant to maintain their original request to reduce the required <br />20-foot rear yard setback to 5-feet and reduce the required side yard setback <br />from 10-feet to 5-feet: <br />OPTION 2: Allow the applicants to reduce the side yard setback from the required 10- <br />feet to 5-feet, however, reduce the rear yard setback from the required 20-feet <br />to 10-feet; <br />OPTION 3: Allow the applicants to reduce the side yard setback form the required 10- <br />feet to 5-feet, however, maintain the required 20-foot rear yard setback as <br />established in the PUD Guidelines; or <br />OPTION 4: Require the applicants to maintain the required 10-foot side yard setback and <br />the required 20-foot rear yard setback. <br />a Structure located outside an approved building envelope shown on the approved <br />tentative map shall follow the natural grade and cut and fill shall be limited to <br />less than three feet in height. <br />
