(11) Willful violation of any of the provisions of the <br /> City Ordinances or Resolutions relating to the <br /> conduct of City officers and employees. <br /> <br /> (12) Failure to submit to a special medical examination <br /> in accordance with Section 23 of this Memorandum of <br /> Understanding or failure to appear at the <br /> designated time and place for such examination or <br /> failure to sign authorizations and/or waivers as <br /> required by the provisions of the City Personnel <br /> Rules. <br /> <br /> (13) Violation of CORPUS Regulations. <br /> <br />Section 22. Grievances <br /> <br />22.1 A grievance is any dispute which involves the <br /> interpretation or application of any provision of this <br /> Memorandum of Understanding excluding, however, those <br /> provisions of this Memorandum of Understanding which <br /> specifically provide that the decision of any City <br /> official shall be final, the interpretation or <br /> application of those provisions not being subject to the <br /> grievance procedure. <br /> <br />22.2 Grievances shall be processed in the following manner: <br /> <br /> (1) Any employee who believes that he/she has a <br /> grievance may discuss his/her complaint with such <br /> management official in the department in which <br /> he/she works as the department head may designate. <br /> If the issue is not resolved within the department, <br /> or if the employee elects to submit his/her <br /> grievance directly to the Association, the <br /> procedures hereinafter specified may be invoked. <br /> <br /> (2) Any employee or any official of the Association may <br /> notify the Personnel Officer in writing that a <br /> grievance exists, stating the particulars of the <br /> grievance, citing the specific section of this <br /> Memorandum of Understanding he/she believes to have <br /> been violated, and, if possible, the nature of the <br /> determination desired. The Personnel Officer shall <br /> have fourteen (14) days in which to investigate the <br /> issues, meet with the complainant and attempt to <br /> reach a satisfactory resolution of the problem.
