DES:sh 12/30/85 <br /> DES:sh 1/19/86R <br /> DES:sh 2/03/86R <br /> DES:sh 2/20/86R <br /> <br /> (d) "Alternate Director" means the director <br /> <br />representing a Par'ty in the absence of a Primary Director, <br />as described in Subparagraph (b) of Paragraph VIII hereof.- <br /> <br /> (e) "Auditor" means the public officer performing the <br />functions of auditor or controller who shall, in accordance <br />with Section 6505.5 of the Act, be of the same party as the <br />Treasurer. <br /> <br /> (f) "Authority" means the agency created by this Joint <br />Exercise of Powers Agreement, to be known as the "Tri-Valley <br />Wastewater Authority". <br /> <br /> (g) "Board" or "Board of Directors" means the <br />governing body of the Authority. <br /> <br /> (h) "Bond Law" means the Revenue Bond Law of 1941, <br />which comprises Chapter 6 (cOmmencing with Section 54300) of <br />Part 1, Division 2, Title 5 of the California Government <br />Code. <br /> <br /> (i) "Capacity Rights" means the right to use <br />wastewater treatment, transmission, disposal, reclamation <br />and/or reuse capacity of any one or more of the Authority's <br /> <br />Facilities expressed as wastewater volume in millions of <br />gallons per day (mgd), biochemical oxygen demand (BOD5) in <br />pounds per day (lbs/day) and total suspended solids (TSS) in <br /> <br />pounds per day, as appropriate for the Facility to which the <br />Capacity Rights may pertain. Capacity Rights initially are <br />acquired for use of a particular Facility in the same <br />proportion as the ownership rights in the Facility of each <br />Participating Member of the Project for which the Facility <br /> <br /> 4 <br /> <br /> <br />
