requires that the drainage from the proposed improvements be connected to an <br />approved point of discharge, subject to review and approval by the City Engineer <br />and/or the Chief Building Official. <br />Effect on Property Value <br />Mr. Chen and Mr. Nguyen expressed concerns about the impact of the proposed <br />second unit on their property values. The State legislation has mandated that <br />second residential units are allowed within residential districts and outlines the <br />limited discretionary review for such projects by local government. The <br />consideration of an increase or decrease in property values is not within the scope of <br />the discretionary review allowed by the State. However, staff is unaware of any data <br />suggesting that second units in a neighborhood decrease the property value of <br />nearby properties. <br />Discretionary Review Criteria <br />Detached second units must meet the following requirements in accordance with the <br />second-unit ordinance implementing State legislation: <br />A. Detached second units shall not exceed fifteen feet in height and shall be limited <br />to one-story structures. <br />/ The proposed height is a maximum of 12 feet, 3 inches at the ridge. <br />B. Detached second units shall be subject to the following minimum setback <br />requirements: <br />/ The proposed second unit adheres to the R-1-20, 000 setback <br />requirements of five feet for the sideyard and ten feet for the rear yard. <br />The location of the second unit is sited such that the side yard setback <br />exceeds the requirement of ten feet. The rear yard setback is proposed at <br />14.5 feet, exceeding the minimum ten-foot requirement. <br />C. The gross floor area of a detached second unit shall not exceed one thousand <br />two hundred (1,200) square feet. <br />/ The second unit is proposed to be 700 square feet. <br />D. Only one other residential unit shall be permitted on a lot with a second unit, and <br />one of the residential units shall be owner occupied. The resident owner shall be <br />a signatory to any lease for the rented unit and shall be the applicant for any <br />permit issued under this chapter. <br />/ The Bawas understand this requirement, and the project is so conditioned. <br />Page 8 of 12 <br />
