ATTACHMENT 12 <br />CHILD CARE CENTERS <br />EV,4LUATOR MANUAL GENERAL LICENSING REQIJIgEMENTS <br />• 101158 EXEMPTION FROM LICENSURE {Continued) 101158 <br />(a){7) PROCEDURE <br />This information is provided to help determine if a recreation program, day camp or <br />org ^;zed camp is exempt from hcensure as specified in Health and Safe~y Code <br />Sections 1596.792 and 1596.793. <br />1. Does the facility provide caze and supervision to children? <br />If no, not subject to licensure. <br />If yes, refer to #2. <br />Drop-in recreation programs for school-age children aze exempt from licensing requirements <br />because, as defined below, they do not provide child care. <br />A drop-in recreational program is in a physical location that children can enter and depart at <br />will. Children aze not requnred to formally sign in/out. But program staff may request <br />children to sign iniout for purposes of accountability (e.g., membership, etc.). Children who <br />participate in drop-in recreational programs do not require monitoring or supervision. Once <br />at the facility children are not assigned specific activities or placed in a structured program. <br />"Drop-in" children may freely choose among a number of recreational activities. <br />Although children in drop-in programs do not require care and supervision, staff are not <br />prohibited from directing them m the proper and safe use of equipment; providing instruction <br />i such as how to kick a soccer ball or do a back flip without injury; and preventing unruly <br />conduct such as fighting. <br />Transportation to or from the facility is not a factor in determining if the facility is a drop-in <br />recreational program. Children may arrive at or depart from the facility on their own. <br />Children's authorized representatives must be clearly informed that children participating in <br />the drop-in recreational program are not there to receive structured care and supervision. <br />Atthonzed representatives must be informed that children have the right to come and go <br />from the facility as they please--and that facility staff will not prevent children from leaving <br />the facility at any time. <br />• <br />01000-03 December 2001 <br />9 <br />
