CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 86-68 RESOLUTION VACATING CAMINO SEVILLE WHEREAS, on March 4, 1986, the City Council received a staff report recommending the vacation of the dedicated street right-of-way for Camino Seville and the public service easement adjacent thereto, more particularly described on Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, the street right-of-way was never used by the public due to redesign of Tract 5397; and WHEREAS, access shall not be cut off to any person's property which, prior to relocation, adjoined the street being vacated; and WHEREAS, there is in place public utility facilities which are in use, and public convenience and necessity require the reservation of easements for these utility facilities; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing that the street right-of-way was never used by the public in a manner meeting the requirements of Section 8330 of the Streets and Highways Code, the street right-of-way for Camino Seville described in Exhibit "A" is hereby vacated. Section 2: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the necessity to vacate the public service easement in a manner meeting the requirements of Section 8333(c) of the Streets and Highways Code, those portions of the public service easement described in Exhibit "A" are hereby vacated. Section 3: That public service easement described in Exhibit "A" and shown on the attached map shall be reserved from the vacation of the street right-of-way and public service easement. Section 4: That from and after the date the resolution is recorded, the street, highway, or public service easement vacated no longer constitutes a street, highway, or public service easement.
