CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-68 <br /> <br /> RESOLUTION VACATING CAMINO SEVILLE <br /> <br />WHEREAS, on March 4, 1986, the City Council received a staff <br /> report recommending the vacation of the dedicated street <br /> right-of-way for Camino Seville and the public service <br /> easement adjacent thereto, more particularly described <br /> on Exhibit "A" attached hereto and incorporated herein <br /> by this reference; and <br /> <br />WHEREAS, the street right-of-way was never used by the public due <br /> to redesign of Tract 5397; and <br /> <br />WHEREAS, access shall not be cut off to any person's property <br /> which, prior to relocation, adjoined the street being <br /> vacated; and <br /> <br />WHEREAS, there is in place public utility facilities which are in <br /> use, and public convenience and necessity require the <br /> reservation of easements for these utility facilities; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing that <br /> the street right-of-way was never used by the public in <br /> a manner meeting the requirements of Section 8330 of the <br /> Streets and Highways Code, the street right-of-way for <br /> Camino Seville described in Exhibit "A" is hereby <br /> vacated. <br /> <br />Section 2: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> necessity to vacate the public service easement in a <br /> manner meeting the requirements of Section 8333(c) of <br /> the Streets and Highways Code, those portions of the <br /> public service easement described in Exhibit "A" are <br /> hereby vacated. <br /> <br />Section 3: That public service easement described in Exhibit "A" <br /> and shown on the attached map shall be reserved from the <br /> vacation of the street right-of-way and public service <br /> easement. <br /> <br />Section 4: That from and after the date the resolution is <br /> recorded, the street, highway, or public service <br /> easement vacated no longer constitutes a street, <br /> highway, or public service easement. <br /> <br /> <br />
