RESOLUTION NO. 08-184 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, ABANDONING A PUBLIC SERVICE EASEMENT ALONG THE SOUTHERLY PROPERTY LINE OF LOT 5 TRACT 5902 WHEREAS, in 1986 the City of Pleasanton approved Tract 5188, and accepted all parcels of land and easements offered for dedication, which included a public service easement along the southerly side of Lot 10; and WHEREAS, in 1990 the City of Pleasanton approved Tract 5902, Foxbrough II; and WHEREAS, at the time of approval of Tract 5902, Foxbrough II, Lots 8 through 14 of Tract 5188 were re-subdivided, and Lot 10 of Tract 5188 was renumbered to Lot 5 of Tract 5902; and WHEREAS, the City has determined the easterly 17 feet of the public service easement along the southerly 14 feet of Lot 5, Tract 5902, is no longer required and the property owners have requested the City to formally abandon the easement. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Abandons the easterly 17 feet of the City's public service easement along the southerly property line of Lot 5, Tract 5902, as shown on the attached Exhibit A, and authorizes the City Clerk to record a certified copy of this resolution. SECTION 2. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on April 15, 2008.
