RESOLUTION NO. 08-184 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />ABANDONING A PUBLIC SERVICE EASEMENT ALONG THE SOUTHERLY <br />PROPERTY LINE OF LOT 5 TRACT 5902 <br />WHEREAS, in 1986 the City of Pleasanton approved Tract 5188, and accepted all <br />parcels of land and easements offered for dedication, which included a public service easement <br />along the southerly side of Lot 10; and <br />WHEREAS, in 1990 the City of Pleasanton approved Tract 5902, Foxbrough II; and <br />WHEREAS, at the time of approval of Tract 5902, Foxbrough II, Lots 8 through 14 of <br />Tract 5188 were re-subdivided, and Lot 10 of Tract 5188 was renumbered to Lot 5 of Tract <br />5902; and <br />WHEREAS, the City has determined the easterly 17 feet of the public service easement <br />along the southerly 14 feet of Lot 5, Tract 5902, is no longer required and the property owners <br />have requested the City to formally abandon the easement. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />SECTION 1. Abandons the easterly 17 feet of the City's public service easement along <br />the southerly property line of Lot 5, Tract 5902, as shown on the attached Exhibit A, and <br />authorizes the City Clerk to record a certified copy of this resolution. <br />SECTION 2. City Clerk shall certify to the passage of this resolution and enter it into <br />the book of original resolutions. <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br />a regular meeting held on April 15, 2008. <br />I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br />resolution was adopted by the City Council at a regular meeting held on the 15th day of April, <br />2008, by the following vote: <br />Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Mayor Hosterman <br />Noes: None <br />Absent: Councilmember throne <br />Abstain: \ <br />arer Diaz, City Clef <br />APPROVED AS TO FORM: <br />~'` l Geial~ l~r~/~i~ <br />Michael H.
