Councifinember Thorne wanted to see the numbers that combine 100% of the first projects and 20% of the second set of projects. Mr. Tassano said therefore, the $1,800 in fees would most likely jump to about $3,000 and staff could provide that direction to the TVTC. City Manager Fialho said; however, when the Council asks for 100% of cost recovery for projects, new development will pay for every piece of that cost and he was not sure this was a good way to approach it, given the City's access to state and federal dollars to provide a match. If you burden the new development with 100% and staff burdens them with another fee of the local traffic impact fee and public facilities and/or park in-lieu fee, a disincentive is created. Mr. Tassano said the subcommittee meets early next week and the Council would not have another meeting prior to that time, and staff can provide information regarding funding at 100%. Councifinember Sullivan said there is a wood/fireplace burning ordinance that appeared for years on the future Council calendar. City Manager Fialho said staff can analyze what other cities are doing and if the Council wants to proceed further, it can refer the matter to the Planning Commission. Councifinember McGovern questioned if the issue could be viewed as a nuisance, and City Attorney Roush said he has held discussion regarding this with the Gwin's, said there are private nuisances where CC&R's are applicable in a subdivision, and there are options for them to pursue this on a private nuisance basis. The only way the City can enforce it as a public nuisance is to have an ordinance that would prohibit portable fireplaces. The Council voiced support for staff to review an ordinance which would prohibit portable fireplaces. Councifinember Cook-Kallio said it is frustrating that people come during oral communication to speak regarding Oak Grove and she asked staff to return with some suggestions to the Council about a southeast ordinance to make sure everyone is heard if the Council chooses to review ideas for a hillside preservation ordinance.
