7. The improvement of the aforesaid road in front of <br />several properties, if done at one time, may achieve cost savings <br />to Subdivider as well as to other affected land owners and would <br />be beneficial to the City in planning and completing a usable, <br />safe street improvement. <br /> <br />II. DESCRIPTION OF WORK <br /> <br /> Subdivider shall plan, construct, finance, or participate <br />in the planning and construction of street improvements along <br />Foothill Road. Street improvements to be constructed adjacent to <br />Parcel 4, Parcel Map 3692, shall be those required by the <br />Subdivision Ordinance of the 'City of Pleasanton for development <br />of streets along the frontage of like property being subdivided. <br />These improvements may include, but are not necessarily limited <br />to, grading, curb and gutter, sidewalk, paving, street lighting, <br />street trees, street monuments, underground utilities, storm <br />drain facilities, sanitary sewer facilities, tree removal, and <br />traffic control devices. Subdivider shall submit improvement <br />plans for the aforesaid work to the City of Pleasanton for <br />approval and shall enter into an improvement agreement for the <br />work itself at the time of construction. <br /> <br />III. TIME OF COMMENCEMENT <br /> <br /> The work to be performed under this agreement shall be <br />commenced at such time in the future as is deemed necessary by <br />the City Engineer. Upon notification that the work is necessary, <br />Subdivider shall commence construction within a reasonable time <br />thereafter and shall diligently pursue the work to completion. <br /> <br />IV. MASTER CONTRACT <br /> <br /> City reserves the right to have all or a portion of the <br />work specified herein done as part of a larger project by means <br />of a master contract. In the event work is done pursuant to such <br />a master contract, Subdivider hereby agrees to pay his share of <br />the cost of the master contract, to be determined on a pro rata <br />basis, within thirty (30) days of notification by the City <br />Engineer of the completion of the work and the calculation of the <br />amount of the pro rata share of the costs involved. <br /> <br />V. DEFAULT: LIEN AGAINST PROPERTY <br /> <br /> In addition to other remedies allowed by law, the <br />performance of the obligation of Subdivider contained herein are <br />secured by the property as shown on Exhibit "A" as Parcel 4, <br />Parcel Map 3692. In the event Subdivider should default on any <br />obligation contained herein, City may exercise a power of sale of <br />the site~ pursuant to the provisions of the then existing State <br />law, in order to satisfy the obligation contained herein. The <br />election to cause the property to be sold may be rescinded by <br />Subdivider if, after the filing of the notice of default and <br />before the sale, Subdivider performs the obligations described <br />herein as well as reimburse City for all costs, fees, and <br />expenses of bringing this action. <br /> <br /> <br />
