x.04.010 <br />Chapter 7.04 <br />GENERAL PROVISIONS* <br />Sections: <br />7.04.010 Title <br />7.04.020 Definitions <br />* Prior ordinance history: Prior Code §§ 4-5.01, 4-5.02; <br />Ord. 1205 § 1, 1985. <br />7.04.010 Title: <br />This title shall be known as ANIMALS. <br />(Ord. 1919 § 1, 2005) <br />7.04.020 Definitions: <br />For the purpose of this title, unless it is <br />plainly evident from the context that a dif- <br />ferent meaning is intended, certain terms <br />used in this title are defined as follows: <br />A. "Animal" means any mammal in- <br />cluding, but not limited to, horse, cow, <br />goat, sheep, dog and cat. <br />B. "Animal control agency" means the <br />police department of the city. <br />C. "At large" means a dog that: <br />1. Is on or in any public property; or <br />2. Is on or in any private property other <br />than that of the owner of the dog unless the <br />person in charge of the private property has <br />consented to the dog being on such private <br />property; and <br />3. Is not securely restrained by a sub- <br />stantial leash, not to exceed six feet (6') if <br />the leash is nonretractable or thirty feet <br />(30') in length if the leash is retractable; or <br />4. Is securely restrained as provided in <br />subsection (C)(3) of this section but is not <br />physically controlled by the owner of the <br />dog. <br />For purposes of this title, any dog in or <br />on any vehicle shall be deemed to be on or <br />in the private property of the owner and <br />deemed to be securely restrained and under <br />the physical control of the owner. <br />D. "Chief of police" means the chief of <br />police of the city or the chief of police's <br />designee. <br />E. "Director" means the chief of police. <br />F. "Dog" means any member of the <br />canine family, and shall include female as <br />well as male dogs. <br />G. "Fees and charges resolution" means <br />the resolution establishing fees and charges <br />adopted by the city council. <br />H. "Health officer" means the chief of <br />police. <br />I. "Horse" means and includes mule, <br />burro, pony, jack, hinny or jenny. <br />J. "Owner" means any person, firm or <br />corporation owning, having an interest in, <br />keeping, or having charge, control, cus- <br />tody, or possession of any animal. <br />K. "Shelter" means a facility designated <br />by the chief of police for impoundment of <br />animals, and (depending on context) the <br />persons who staff such facility.
