6.18.010 <br />Chapter 6.18 <br />MEDICAL MARIJUANA <br />DISPENSARIES <br />Sections: <br />6.18.010 Definitions. <br />6.18.020 Operation of medical <br /> marijuana dispensaries <br /> prohibited. <br />6.18.030 Penalty. <br />6.18.010 Definitions. <br />As used in this chapter, the following <br />terms shall be ascribed the following <br />meanings: <br />A. "Medical marijuana" means mari- <br />juana in compliance with California Health <br />and Safety Code Sections 11362.5 et seq. <br />B. "Medical marijuana dispensary" <br />means any facility or location, whether <br />fixed or mobile, where medical marijuana <br />is made available to, distributed by, or dis- <br />tributed to one or more of the following: a <br />qualified patient, a person with an identifi- <br />cation card, or a primary caregiver, in ac- <br />cordance with California Health and Safety <br />Code Section 11362.5 et. seq., as amended. <br />A medical marijuana dispensary shall <br />not include the following uses, so long as <br />such uses comply with this code, Califor- <br />nia Health and Safety Code Section <br />11362.5 et seq., as amended, and other ap- <br />plicable law: <br />1. A clinic licensed pursuant to Chapter <br />1 of Division 2 of the California Health <br />and Safety Code, as amended; <br />2. A health care facility licensed pursu- <br />ant to Chapter 2 of Division 2 of the Cali- <br />fornia Health and Safety Code, as <br />amended; <br />3. A residential care facility for persons <br />with chronic life-threatening illness li- <br />censed pursuant to Chapter 3.01 of Divi- <br />sion 2 of the California Health and Safety <br />Code, as amended; <br />4. A residential care facility for the eld- <br />erly licensed pursuant to Chapter 3.2 of <br />Division 2 of the California Health and <br />Safety Code, as amended; <br />5. A hospice or a home health agency, <br />licensed pursuant to Chapter 8 of Division <br />2 of the California Health and Safety Code, <br />as amended. <br />C. "Person with an identification card" <br />shall have the meaning given that term by <br />California Health and Safety Code Section <br />11362.7, as amended. <br />D. "Primary caregiver" shall have the <br />meaning given that term by California <br />Health and Safety Code Section 11362.7, <br />as amended. <br />E. "Qualified patient" shall have the <br />meaning given that term by California <br />Health and Safety Code Section 11362.7, <br />as amended. (Ord. 1955 § 1, 2007) <br />6.18.020 Operation of medical <br />marijuana dispensaries <br />prohibited. <br />No person shall operate or permit to be <br />operated a medical marijuana dispensary in <br />or upon any premises in the city. (Ord. <br />1955 § 1, 2007) <br />6.18.030 Penalty. <br />Any person violating any of the provi- <br />sions of this chapter shall be guilty of a <br />misdemeanor. Any person convicted of a <br />misdemeanor under the provisions of this <br />chapter shall be punished by a fine of not <br />more than one thousand dollars <br />150-1 (Pleasanton Supp. No. 19.9-07) <br />
