Mayor Hosterman suggested continuing to keep those first projects, and in the meantime the <br />Council discuss the larger issue of getting people off of the highways. Mr. Tassano agreed and <br />noted that a Wheels project is identified in the first 11 projects. <br />Councilmember Thorne wanted to see the numbers that combine 100% of the first projects and <br />20% of the second set of projects. Mr. Tassano said therefore, the $1,800 in fees would most <br />likely jump to about $3,000 and staff could provide that direction to the TVTC. City Manager <br />Fialho said; however, when the Council asks for 100% of cost recovery for projects, new <br />development will pay for every piece of that cost and he was not sure this was a good way to <br />approach it, given the City's access to state and federal dollars to provide a match. If you <br />burden the new development with 100% and staff burdens them with another fee of the local <br />traffic impact fee and public facilities and/or park in-lieu fee, a disincentive is created. <br />Mr. Tassano said the subcommittee meets early next week and the Council would not have <br />another meeting prior to that time, and staff can provide information regarding funding at 100%. <br />Motion: It was m/s by Hosterman/Cook-Kallio to retain the local match of 20% for both the <br />original TVTC projects and the new proposed projects with priority given to the original projects. <br />Motion passed by the following vote: <br />Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br />Noes: None <br />Absent: None <br />MATTERS INITIATED BY COUNCIL <br />Mayor Hosterman questioned Council support to find ways of reducing or banning outside <br />burning through adoption of an ordinance. Councilmember Sullivan said there is a <br />wood/fireplace burning ordinance that appeared for years on the future Council calendar. City <br />Manager Fialho said staff can analyze what other cities are doing and if the Council wants to <br />proceed further, it can refer the matter to the Planning Commission. <br />Councilmember McGovern questioned if the issue could be viewed as a nuisance, and City <br />Attorney Roush said he has held discussion regarding this with the Gwin's, said there are <br />private nuisances where CC&R's are applicable in a subdivision, and there are options for them <br />to pursue this on a private nuisance basis. The only way the City can enforce it as a public <br />nuisance is to have an ordinance that would prohibit portable fireplaces. <br />The Council voiced support for staff to review an ordinance which would prohibit portable <br />fireplaces. <br />Councilmember Cook-Kallio said it is frustrating that people come during oral communication to <br />speak regarding Oak Grove and she asked staff to return with some suggestions to the Council <br />about a southeast ordinance to make sure everyone is heard if the Council chooses to review <br />ideas for a hillside preservation ordinance.
