CHILD CARE CENTERS <br />EVALUATOR MANUAL GENERAL LICENSING ~QUIREMENTS <br />101158 EXEMPTION FROM LICENSURE (Continued) 10115$ <br />{a)(7) PROCEDURE (Continued) <br />All program descriptions and advertisements must cleazly state that the facility provides <br />drop-in recreational actvities, that children have the ::ght to come and go from the facilirf, <br />and that facility staff will not prevent children from leaving the facility. Program <br />descriptions and advertisements cannot state that the facility is providing child care. <br />As a condition for exemption, the facility must inform each child's authorized representative <br />of the foregoing. The facility must also have a signed statement from each authorized <br />representative indicating that he or she understands the conditions under which the facility <br />operates, i.e., that the facility is not a licensed child caze center. If the facility doesn't know <br />who the authorized representatives are (for example, the facility doesn't obtain that <br />information as part of its membership process), the facility doesn't need to obtain that <br />documentation. <br />2. Does the facility claim exemption from Iicensure because it provides a recreation <br />program? . <br />If no, subject to licensure. <br />If yes, refer to #3. <br />3. Does the facility meet the exemption criteria for a public recreation program pursuant <br />to Health and Safety Code Section 1596.792 as a ublic recreation program? <br />If no, refer to #4. <br />If yes, not subject to licensure. <br />Section 1596.792{g} of the Health and Safety Code states: <br />~4ny public recreation program. "Public recreation program " means a program <br />operated by the state, city, county, special district, school district, community college <br />district, chartered city, or chartered city and county that meets either of the following <br />criteria: <br />1. The program is operated only during hours other than normal school hours <br />for grades K-1 ? inclusive, in the public school district where the program <br />is located, or operated only during periods when students in grades K I2, <br />inclusive, are normatly not in session in the public school district where the <br />program is located, for either of the following periods: <br />(A) For under 16 hours per week <br />(B) For a total of 12 weeks or less during a 12-month period.
