h. "Public-Private Partnership" means any project built on city-owned land, <br />primarily funded by the City or built under a Disposition and Development Agreement with the <br />City. <br />i. "Renovation" means any change, addition, or modification to an existing <br />Landscape. <br />j. "Traditional Public Works Project" means heavy construction projects such as <br />pump stations, flood control improvements, roads, and bridges, as well as traffic lights, <br />sidewalks, bike paths, bus stops, and associated infrastructure on City owned and maintained <br />property. <br />SECTION 3. STANDARD FOR COMPLIANCE <br />a. All Covered Projects with landscapes initiated on or after the effective date of this <br />Ordinance shall meet the minimum Bay Friendly Landscape Scorecard points. <br />b. In an effort to reduce operating and maintenance costs, landscape projects that do <br />not meet the financial threshold of a covered project should be constructed to meet as many Bay- <br />Friendly Landscaping Scorecard points as practical. <br />c. The City Engineer shall regularly review its project design specifications for <br />Traditional Public Works Projects to include the best environmental practices and applicable <br />Bay-Friendly landscape practices. <br />SECTION 4. PROMULGATION OF IMPLEMENTING REGULATIONS <br />a. The City Manager shall, within six months of approval of these requirements, <br />promulgate any rules and regulations necessary to incorporate these Bay-Friendly landscaping <br />requirements into the appropriate design, construction, maintenance and development agreement <br />documents prepared for the applicable Covered Projects. <br />SECTION 5. UNUSUAL CIRCUMSTANCES <br />a. Compliance with these requirements may be waived where the City Council has <br />determined that the public interest would not be served by complying with such provisions. <br />3 <br />
