Box 520 <br />Pleasanton, California 94566 <br /> <br /> EASEMENT AGREEMENT <br /> <br /> THIS EASEMENT AGREEMENT ("Agreement") is entered <br />into this__day of February, 1986, by and between the CITY <br />OF PLRASANTON, a municipal corporation ("City"), HOPYARD <br />PARTNERS, a California limited partnership ("Hopyard"), and <br />the ALAMEDA COUNTY FLOOD CONTROL AND WATER CONSERVATION <br />DISTRICT, ZONE 7, a ("Zone 7"). <br /> <br /> RECITALS <br /> <br /> A. Hopyard owns certain real property located in <br />the City of Pleasanton, County of Alameda, State of <br />California, consisting of approximately 4.5 acres at the <br />northeast corner of Hopyard Road and Valley Avenue and <br />comprising Assessor's Parcel Numbers 946-3215-15 through 21, <br />inclusive, and an adjacent 1.56 acre parcel, Assessor's <br />Parcel Numbers 946-3215-11,. 12 and 14 (collectively, <br />"Hopyard Center"), as more particularly described in <br />Exhibit A. On November 5, 1985, City approved PUD-85-10 by <br />Ordinance No. 1227. <br /> <br /> B. PUD-85-10 makes development of the adjacent <br />1.56 acre parcel contingent upon receipt of legal assurances <br />that Hopyard will construct additional parking spaces over <br />the Pleasanton Canal on property owned by City <br /> ("Parcel B"). Parcel B is more particularly described in <br />Exhibit B, attached hereto. The City and Hopyard entered <br />into an In-Lieu Parking Agreement ("In-Lieu Parking <br />Agreement") dated May 21, 1985 in order to permit Hopyard to <br />finish leasing existing building space in the 4.5 acre <br />parcel pending completion of arrangements for construction <br />of the parking area on Parcel B. <br /> <br />C. Under established City parking requirements <br />(and allowing a ten percent reduction for the combined uses <br />with different parking characteristics), the buildings <br />approved by PUD-85-10 would, if leased to the parking <br />intensity permitted by the PUD, require approximately three <br />hundred eleven (311) parking spaces. The design approved by <br />PUD-85-10 shows two hundred fifty-two (252) parking spaces <br />on-site and requires that Hopyard construct approximately <br />ninety-four (94) additional spaces on Parcel B.
