RESOLUTION NO. <br />RESOLUTION APPROVING THE 2008 WEED ABATEMENT PROGRAM AND <br />AUTHORIZING THE ABATEMENT OF WEEDS, DIRT, RUBBISH OR REFUSE <br />UPON OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES WITHIN THE <br />CITY OF PLEASANTON <br />WHEREAS, at its meeting of March 18, 2008, Council adopted Resolution No. <br />08-176 declaring as a public nuisance all weeds, dirt, rubbish or refuse upon or in front <br />of certain described properties within the City of Pleasanton as more particularly set <br />forth in Exhibit "A", attached thereto and attached hereto as Exhibit "A"; and <br />WHEREAS, Resolution No. 08-176 was adopted pursuant to the provisions of <br />Government Code Sections 39560-39588; and <br />WHEREAS, Resolution No. 08-176 designated April 15, 2008, at the hour of 7:00 <br />p.m., in the Pleasanton City Council Chambers, as the time, date and place to hear and <br />consider objections to the abatement and removal of weeds, rubbish or refuse upon or <br />in front of certain described properties within the City of Pleasanton more particularly set <br />forth in Exhibit "A" to Resolution No. 08-176 and attached hereto as Exhibit "A"; and <br />WHEREAS, the Fire Inspector was charged with the responsibility to perform the <br />duties imposed by Government Code Sections 39560-39588, and he did prepare <br />notices to destroy weeds and remove rubbish and refuse; and <br />WHEREAS, the City Clerk, in accordance with Government Code Section <br />39567.1, did mail written notice of the proposed abatement and removal and the public <br />hearing to all persons owning property described in Resolution No. 08-176; and <br />WHEREAS, the City Council did hold a public hearing on April 15, 2008 and no <br />protests were presented; and <br />WHEREAS, abatement of the nuisance may be performed by the City or by a <br />contractor; and <br />WHEREAS, before the weeds are abated by the City or a contractor, any <br />property owner may remove the weeds, rubbish or refuse at the property owner's own <br />expense; <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br />THE FOLLOWING: <br />SECTION 1. The Fire Inspector is ordered to abate the nuisance declared by <br />Resolution No. 08-176 by causing the weeds, dirt, rubbish and refuse to be removed by <br />
