RESOLUTION NO. 08-176 <br />RESOLUTION DECLARING .THAT WEEDS, DIRT, RUBBISH, AND REFUSE UPON <br />OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES WITHIN THE CITY OF <br />PLEASANTON CONSTITUTE PUBLIC NUISANCES AND THAT THEY BE ABATED, <br />AND SETTING A PUBLIC HEARING REGARDING THE ABATEMENT. <br />WHEREAS, there is attached hereto and incorporated by reference herein as if fully set <br />forth a list of properties to which this resolution applies; and <br />WHEREAS, said list of properties specifically sets forth street, lot and block numbers <br />according to the official assessment map for each piece of property; and <br />WHEREAS, the properties list have, upon or in front of them, weeds, as defined by <br />Section 39561.5 of the Government Code, dirt, rubbish, or refuse; and <br />WHEREAS, after consideration of evidence, it appears that said weeds, dirt, rubbish, <br />and refuse are a public nuisance in that they constitute a fire hazard, or that said materials are <br />noxious or dangerous and as such, are detrimental to the health, safety and welfare of the City <br />of Pleasanton and, as such, shall be removed; and <br />WHEREAS, it appears that the public nuisances referred to herein are recurrent and <br />seasonal in nature. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />SECTION 1. That the weeds, dirt, rubbish and refuse upon on or in front of the <br />properties described in the list of attached hereto and incorporated by reference herein, are <br />declared a public nuisance and are to be abated and removed pursuant to the procedure <br />provided by Section 39560-39588 of the Government Code. <br />SECTION 2.
