CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-43 <br /> <br /> RESOLUTION VACATING A PORTION OF THE PUBLIC SERVICE <br /> EASEMENT WITHIN LOT 3, PARCEL MAP 4390, HACIENDA GARDENS <br /> <br />WHEREAS, on February 4, 1986, the City Council received a staff <br /> report (SR 86:40) recommending the vacation of a portion <br /> of a public service easement in Lot 3, Parcel Map 4390, <br /> Hacienda Gardens, more particularly described in legal <br /> descriptions and plat labeled Exhibit "A" and Exhibit <br /> "B", attached hereto and incorporated herein by this <br /> reference; and <br /> <br />WHEREAS, the proposed vacation of a portion of the public service <br /> easement is consistent with the goals and policies of <br /> the General Plan; and <br /> <br />WHEREAS, no facilities exist in the easement proposed for <br /> abandonment nor are any prospective facilities planned <br /> for the portion of the easement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> necessity to vacate the public service easement in a <br /> manner meeting the requirements of Section 8333(c) of <br /> the Streets and Highways Code, that portion of the <br /> public service easement described in the attached <br /> exhibits is hereby vacated. <br /> <br />Section 2: The clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the office of <br /> the Alameda County Recorder upon its becoming effective. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
