WHEN RECORDED, RETURN TO: <br />City Attorney <br />P. O. Box 520 <br />Pleasanton, CA 94566 <br /> <br /> LAND EXCHANGE AGREEMENT: BRADDOCK & LOGAN <br /> <br /> THIS AGREEMENT is made and entered into on the day of <br /> , 1986 by and between BRADDOCK & LOGAN <br />ASSOCIATES, a California General Partnership (hereinafter <br />referred to as "BL") and the CITY OF PLEASANTON, a Municipal <br />Corporation (hereinafter referred to as "City"). BL and City <br />agree as set forth below. <br /> <br /> WHEREAS, BL is the owner of that certain real property <br />consisting generally of 13.1 acres just south of Bernal Avenue in <br />the City of Pleasanton (AP #946-3630-1-2 and 94-157-5-7) and an <br />additional 0.8 acre parcel recently acquired from the City and <br />County of San Francisco along the westerly edge of the 13.15 acre <br />parcel; and <br /> <br /> WHEREAS, the City has approved PUD-84-21 by Ordinance No. <br />1179 granting development plan approval for a 262 unit apartment <br />complex on the aforementioned property; and <br /> <br /> WHEREAS, the purpose of this Agreement is to clarify the <br />manner in which the City and BL will comply with various <br />conditions of the above-mentioned PUD and to set forth the <br />procedure to be followed by each party; and <br /> <br /> WHEREAS, BL acquired title to the 0.44 acres of the real <br />property previously owned by the City and County of San Francisco <br />referred to in Condition No. 2 of the above-mentioned PUD on <br />November 19, 1985 (see Exhibit A); said 0.44 acres being a part <br />of the larger 0.8 acre parcel acquired from the City and County <br />of San Francisco; and <br /> <br /> WHEREAS, BL has requested annexation of said property to be <br />initiated by the City on November 11, 1985 (see Exhibit A); and <br /> <br /> WHEREAS, BL acquired title to a portion of the easterly <br />one-half (1/2) of the proposed 84 foot right-of-way pursuant to <br />Condition No. 5 of the above-mentioned PUD on November 19, 1985 <br />(see Exhibit A); <br /> <br /> NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br /> <br /> 1. Access Street to Senior Citizens' Center. <br /> <br /> (a) Upon completion of annexation proceedings and <br />execution of the improvement agreement described in Section l(b), <br />BL will offer for dedication to City a portion of the easterly <br /> <br /> - 1 - <br /> <br /> <br />
