PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-87-95 <br />RESOLUTION DENYING THE PUD REZONING AND DEVELOPMENT PLAN <br />AS PROPOSED UNDER CASE PUD-87-21 <br />WHEREAS, Merle Kral, et al have applied for Planned Unit <br />Development rezoning and development plan approval for a <br />five-parcel, single-family residential development to be <br />located on an approximately 1.2 acre site located at <br />3775 Mohr Avenue; and <br />WHEREAS, zoning for the property is "S" (Study) District; and <br />WHEREAS, a negative declaration of environmental impacts was <br />adopted at the Planning Commission duly noticed public <br />hearing of August 26, 1987; and <br />WHEREAS, the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />at their duly noticed public hearing of September 9, <br />1987; and <br />WHEREAS, the Planning Commission found that the PUD rezoning and <br />five-parcel development plan proposed is inappropriate <br />for the site and would not sufficiently permit retention <br />of the flavor of the site. Not only would the site <br />character change, the parcel development plan has <br />numerous practical drawbacks which would result in an <br />undesirable subdivision. The site is oriented toward <br />and is physically associated with the adjacent large-lot <br />developments east of the site. With development <br />proposal involving four or more parcels and requirements <br />for public street access, the need for appropriate <br />buildings sites will require substantial removal of <br />trees and buildings that might otherwise be retained. <br />In addition, the orientation of future structures, <br />usable open space, accessory structures, and fencing <br />will all impact on the site internally as well as <br />externally. These are elements which contribute <br />significantly toward the atmosphere of the area. The <br />preservation of this atmosphere is directly related to <br />the intensity of the development proposed. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Denies the application for PUD rezoning and <br />development plan as proposed by the applicant under Case <br />PUD-87-21. <br />- 1 - <br />
