RESOLUTION NO. 08-165 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DECLARING A PORTION OF (OLD) VINEYARD AVENUE AS SURPLUS AND <br />ABANDONING THE CITY'S INTEREST IN SUCH PROPERTY AND OTHER <br />PROPERTY <br />WHEREAS, on January 15, 2008, the City Council received a staff report recommending <br />that a portion of (Old) Vineyard Avenue right of way be declared surplus and that the City <br />abandon its interest therein, which right of way is more particularly described in Exhibit A <br />attached hereto and incorporated herein by reference; and <br />WHEREAS, the January 15, 2008 staff report also recommended that the City Council <br />abandon other right of way within (Old) Vineyard Avenue, which right of way is more particularly <br />described in Exhibit B attached hereto and incorporated herein by reference; and <br />WHEREAS, those portions of (Old) Vineyard Avenue proposed to be abandoned are no <br />longer needed for present or future street use due to the realignment of Vineyard Avenue; and <br />WHEREAS, by abandoning these portions of (Old) Vineyard Avenue, access will not be <br />cut off to any property that adjoins those portions of (Old) Vineyard Avenue proposed to be <br />abandoned; and <br />WHEREAS, no public service easements within the areas to be abandoned are to be <br />terminated as a result of this proposed abandonment. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />SECTION 1. Based upon the findings stated above, that portion of (Old) Vineyard <br />Avenue right of way described in Exhibit A is hereby declared surplus and is abandoned. <br />SECTION 2. Based upon the findings stated above, that portion of (Old) Vineyard <br />Avenue right of way described in Exhibit B is hereby abandoned. <br />SECTION 3. The City Clerk shall record a certified copy of this resolution with the <br />office of the Alameda County Recorder. <br />SECTION 4. This resolution shall become effective upon its passage and adoption. <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br />a regular meeting held on January 15, 2008. <br />I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br />resolution was adopted by the City Council at a regular meeting held on the 15th day of <br />January, 2008, by the following vote: <br />
