PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-S7-108 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR EUGENE <br />DE CHRISTOPHER AS FILED UNDER CASE UP-87-42 <br />WHEREAS, Application of Eugene de Christopher for a conditional <br />use permit to operate a take-out food establishment to <br />be located at 336 St. Mary Street; and <br />WHEREAS, zoning for the property is C-C (Central Commercial) <br />District; and <br />WHEREAS, the Planning Commission made the following findings: <br />a) That the proposed location of the conditional use <br />is in accordance with the objectives of this <br />chapter and the purpose of the district in which <br />the site is located: <br />The proposed us~_= is compatible with other uses <br />within the downtown area and will contribute to the <br />diversity of the uses in the central business <br />district; <br />b) That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or be materially <br />injurious to the properties or improvements in the <br />vicinity: <br />As conditioned, recommended limitation of three <br />delivery vehicles maximum at any time during <br />business hours should ensure that parking demands <br />generated by the use will not be excessive; <br />c) That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter: <br />As proposed anal conditioned, each applicable <br />provisions will be satisfied. <br />WHEREAS, projects of this nature are categorically exempt from <br />the requirements of the California Environmental Quality <br />Act. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Case UP-87-42 as herein described subject to <br />the following conditions: <br />- 1 - <br />
