PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-87-115 RESOLUTION APPROVING TRACT 5840, B-W CONSTRUCTION COMPANY WHEREAS, B-W Construction Company has applied to subdivide an approximately 2.3 acre site into 28 parcels for residential townhouse development and one parcel under common ownership located at 555 and 571 St. John Street; and WHEREAS, zoning for the property is PUD (Planned Unit Development) - High Density Residential District; and WHEREAS, at their duly noticed public hearing of October 28, 1987, the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff concerning this application; and WHEREAS, a negative declaration was prepared for the PUD rezoning and development plan approval for the subject property. The tentative map is in conformance with the conditions of that development plan and subdivision of the property was included within the scope of that negative declaration; and WHEREAS, the Planning Commission finds that Tract 5840 conforms to the PUD zoning district and the General Plan of the City of Pleasanton. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Approves Tract 5840, application of B-W Construction Company to subdivide an approximately 2.3 acre site into 28 parcels for residential townhouse development and one parcel under common ownership located at 555 and 571 St. John Street subject to the following conditions: 1. That the development be substantially as shown on Tentative Tract Map 5840 on file with the Planning Department. 2. That the development is subject to all conditions of approval for Case PUD-87-20. 3. That the Developer through CC&R's shall create a homeowners' association with sufficient power to maintain and be responsible for maintaining all commonly owned facilities and private utilities.
