PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-87-115 <br />RESOLUTION APPROVING TRACT 5840, B-W CONSTRUCTION <br />COMPANY <br />WHEREAS, B-W Construction Company has applied to subdivide an <br />approximately 2.3 acre site into 28 parcels for <br />residential townhouse development and one parcel under <br />common ownership located at 555 and 571 St. John Street; <br />and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - High Density Residential District; and <br />WHEREAS, at their duly noticed public hearing of October 28, <br />1987, the Planning Commission considered all public <br />testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, a negative declaration was prepared for the PUD rezoning <br />and development plan approval for the subject property. <br />The tentative map is in conformance with the conditions <br />of that development plan and subdivision of the property <br />was included within the scope of that negative <br />declaration; and <br />WHEREAS, the Planning Commission finds that Tract 5840 conforms <br />to the PUD zoning district and the General Plan of the <br />City of Pleasanton. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Tract 5840, application of B-W Construction <br />Company to subdivide an approximately 2.3 acre site into <br />28 parcels for residential townhouse development and one <br />parcel under common ownership located at 555 and 571 St. <br />John Street subject to the following conditions: <br />1. That the development be substantially as shown on <br />Tentative Tract Map 5840 on file with the Planning <br />Department. <br />2. That the development is subject to all conditions <br />of approval for Case PUD-87-20. <br />3. That the Developer through CC&R's shall create a <br />homeowners' association with sufficient power to <br />maintain and be responsible for maintaining all <br />commonly owned facilities and private utilities. <br />The CC&R's shall provide that the City be granted <br />- 1 - <br />
