PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-87-128 <br />RESOLUTION DENYING THE APPLICATION OF TIOGA CONSTRUCTION <br />COMPANY AS FILED UNDER CASE PUD-80-15-5D <br />WHEREAS, Tioga Construction Corp. has applied for Planned Unit <br />development rezoning and development plan approval for <br />an approximately 30,150 square feet mixed-use commercial <br />complex to be located on an approximately 3.63 acre site <br />located at the southeast corner of the intersection of <br />Santa Rita Road and Pimlico Drive; and <br />WHEREAS zoning for the property is PUD (Planned Unit <br />Development) - Commercial District; and <br />WHEREAS, at its meeting of November 24, 1987, the Planning <br />Commission recommended approval of a proposed negative <br />declaration for Case PUD-80-15-5D after considering all <br />public testimony, relevant exhibits, and recommendations <br />of the City staff; and <br />WHEREAS, the Planning Commission expressed concerns with <br />increased traffic, 24-hour operation of the proposed <br />establishment, sale of beer and wine with close <br />proximity of the County jail at a gas station facility <br />after considering all public testimony. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1: Denies Case PUD-80-15-5D, application of Tioga <br />Construction Corporation for Planned Unit development <br />rezoning and development plan approval for an <br />approximately 30,150 s;q. ft. mixed-use commercial <br />complex to be located on an approximately 33.63 acre <br />site located at the southeast corner of the intersection <br />of Santa Rita Road and Pimlico Drive. <br />Section 2: This resolution shall become effective immediately <br />after its passage and adoption. <br />- 1 - <br />
