CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 87-194 RESOLUTION DETERMINING SATISFACTORY COMPLIANCE OF CONDITIONS FOR LIN/KOTTINGER RANCH WILLIAMSON ACT AGRICULTURAL PRESERVE CONTRACT 1971-73 CANCELLATION AND AUTHORIZATION FOR DIRECTOR OF PLANNING AND COMMUNITY DEVELOPMENT TO PREPARE AND RECORD CERTIFICATE OF CANCELLATION WHEREAS, the City was in receipt of an application from Frederick and Jennifer Lin for cancellation of Williamson Act Agricultural Preserve Contract 1971-73 under the provisions of California Government Code Section 51282.1 to allow development of the site for residential use consistent with City General Plan policies; and WHEREAS, on October 7, 1986, Council adopted Resolution No. 86-483 approving tentative cancellation of said contract and setting forth conditions to be satisfied prior to final cancellation; and WHEREAS, Council is in receipt of a request from Frederick and Jennifer Lin to determine that such conditions have been satisfactorily complied with; and WHEREAS, Council received the City staff's report and recommendation for determination of compliance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council determines that the conditions set forth in Resolution No. 86-483 have been satisfied for the application of Frederick and Jennifer Lin for Cancellation of Williamson Act Land Conservation Agreement for an approximately 230 acre site located generally in the area south of the intersection of Kottinger Drive and Bernal Avenue. Section 2: Council authorizes and directs the Director of Planning and Community Development to execute the Certificate of Cancellation for said contract and cause same to be recorded. Section 3: This resolution shall become effective immediately upon its passage and adoption.
