CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 87-191 RESOLUTION VACATING AN EASEMENT AND ACCEPTING AN EASEMENT DEDICATION FROM PRUDENTIAL INSURANCE COMPANY FOR A PUBLIC SERVICE EASEMENT ALONG A PORTION OF WEST LA8 POSITAS BOULEVARD WHEREAS, on May 5, 1987, the City Council received a staff report (SR 87:195) recommending an easement vacation along a portion of West Las Positas Boulevard, more particularly described in legal description and plat labeled Exhibit "A", and acceptance of an easement dedication from Prudential Insurance Company, more particularly described in legal description and plat labeled Exhibit "B", attached hereto and incorporated herein by this reference; and WHEREAS, the proposed vacation of a portion of the public service easement is consistent with the goals and policies of the General Plan; and WHEREAS, no facilities exist in the easement proposed for abandonment nor are any prospective facilities planned for the portion of the easement; and WHEREAS, public convenience and necessity require the reservation of an easement for public service over the above vacated land; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the necessity to vacate the public service easement in a manner meeting the requirements of Section 8333(a) of the Streets and Highways Code, that portion of the public service easement described in the attached exhibit is hereby vacated. Section 2: That public service easement described in Exhibit "A" and shown on the attached map shall be reserved for a public service easement. Section 3: The Grant of Easement from Prudential Insurance Company to the City of Pleasanton for a public service easement for a sidewalk is hereby accepted and the appropriate City officers are instructed to take whatever action necessary to implement said acceptance.
