NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Case UP-87-62 as herein described subject to <br />the following conditions: <br />1. That the use shall conform substantially to the <br />location and details of operation, Exhibit A (dated <br />January 5, 1988), on file with the Planning <br />Department. <br />2. That if, at anytime in the future, the ownership <br />and/or management of the restaurant is unable to <br />control the activities of its patrons such that the <br />presence of the restaurant poses a nuisance to <br />surrounding uses or to the City in general, the <br />Planning Commission may review and, if necessary, <br />revoke the subject conditional use permit. <br />3. That if problems occur in the vicinity of the site <br />with regard to traffic control and enforcement by <br />the Police Department, signs shall be erected at <br />all entrances to the Stoneridge Mall parking lot <br />along Stoneridge Mall Road. Said signs shall state <br />the enforcement of Section 21107.8 of the <br />California Vehicle Code (CVC) on the subject <br />premises, and shall be designed and sited as <br />prescribed in the CVC. In the event that signs are <br />not posted as required above, this approval shall <br />become null and void. <br />4. That alarms and "panic hardware" shall be <br />installed, implemented, and maintained at the two <br />emergency exits in the restaurant which lead to the <br />mall service corridor and service court. Said <br />improvements shall be installed subject to the <br />approval of the Chief Building INspector prior to <br />the opening of business. That alarms shall be in <br />operation during all hours in which the mall is <br />closed. <br />That the applicant shall apply for and obtain all <br />applicable City permits for the restaurant <br />establishment prior to commencement of business. <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON ON THE 27TH DAY OF JANUARY 1988 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Berger, Hoyt, Michelotti, Tarver and <br />Chairman Lindsey <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. PC-88-12 <br />1/27/88 <br />
