February 10, 1988 <br />adjacent properties. The height of all light <br />standards shall be such that no glare is directed <br />to the adjacent residential properties. <br />5. That the final building design for the restaurant <br />pad be submitted for separate review and approval <br />by the Planning Commission and City Council. <br />6. That the entire site shall be maintained in a clean <br />and orderly manner at all times. No equipment, <br />dilapidated vehicles, products, etc., shall be <br />stored outside of any building. In the event that <br />blowing trash becomes a problem, the applicant <br />shall be responsible for installing additional <br />mitigation measures as required by the Planning <br />Director. <br />7. That at no time shall any roof-mounted mechanical <br />equipment project above the roof parapet of any <br />building. <br />8. That at no time shall any vehicle maintenance (such <br />as overhauls, oil changes, tire changes, etc.) be <br />allowed on-site in conjunction with the service <br />station operation. <br />9. That at no time shall balloons, banners, pennants, <br />or other attention-getting advertising devices be <br />utilized on the site. <br />10. That the applicant be responsible for its pro-rata <br />share of the interim street improvements at the <br />intersection of Santa Rita Road and Pimlico Drive <br />and the intersection of the westbound I-580 <br />off-ramp and Tassajara Road, as determined by the <br />City Engineer. Payment of this pro-rata share <br />shall be made when directed by the City Engineer. <br />il. That at no time shall the sale of any alcoholic <br />beverage be permitted at the food mart facility. <br />12. That prior to the food mart beginning its use, the <br />applicant shall record covenants, conditions, and <br />restrictions between the various parcels to be <br />created giving each tenant, or owner, the right to <br />enforce -- and to have enforced by local police <br />officials, employees, or private security services <br />-- traffic, public drinking, loitering, and other <br />laws and regulations when violated anywhere on the <br />site subject to the PUD development plan. Approval <br />shall be subject to securing similar enforcement <br />rights on the grounds of the adjoining Pimlico <br />Plaza property. The owner, tenant, and/or <br />employees of the food-mart shall be responsible for <br />maintaining the exterior of the food mart premises <br />free of loitering, public drinking, or other <br />- 2 - <br />
