CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 87-173 RESOLUTION DIRECTING CITY STAFF TO INVOKE PENALTIES FOR VIOLATIONS WHEREAS, at their meeting of February 25, 1987, the Planning Commission directed staff to evaluate existing procedures for enforcing development conditions, existing penalties for violations as established in the Municipal Code, and a draft resolution for consideration by the Planning Commission to be sent to the City Council; and WHEREAS, City procedures for monitoring development plan specifications and conditions occur at three levels: plan checking, monitoring of construction, and final building permit approval. Within the past several years, City staff has increased efforts to coordinate plan checking and inspection among Departments. With recent increases in workloads, however, plan checking services have been contracted to private organizations and inspection services switched by departments resulting in a new education process between departments and consultants; and WHEREAS, inconsistencies between approved plans and actual construction may occur, then the developer is required to repair the mistake prior to obtaining a final building permit. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. The City Council hereby instructs the staff to invoke the City of Pleasanton, Municipal Code General Provision, Chapter 1.12 and General Penalty 1.12.020, upon discovery of violations of same. It is the intent of the Council that this schedule of fines be invoked in all cases in addition to the necessity of requiring the project to be returned to its approved state. - 1 -
