No. 1866) Request for Determination Regarding Mitigation - Sunol/First/Bernal Intersection Dear Mr. Wilson: This is a follow up to our recent meeting to discuss the status of the Sunol/First/Bernal Intersection improvements. Per your direction, this letter serves as our formal request for a City Council determination regarding the construction of the required traffic improvements at the subject location. Ponderosa Homes was conditioned to construct several city-wide traffic improvements as part of the Busch/Ironwood Project Approval. Most of the required offsite traffic work is now completed, however, after receiving approval of the improvement plans in 2004, the City instructed Ponderosa to delay the start of construction. As you may recall, the improvements at this intersection also included coordination and authorization from the Pleasanton School District for acquisition of street right of way. Due to the amount of time that has passed, Ponderosa would like to obtain confirmation as to whether the City intends for this work to proceed, and if not, that the bonds be exonerated at this time with Ponderosa paying its actual fair-share of the Project's impact at this intersection.
