EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PUD-81-28-5M, City of Pleasanton <br />30 West Neal Street <br />March 4, 2008 <br />1. The masonry wall shall be maintained in substantial conformance to the development <br />plans, Exhibit A, dated "Received, July 10, 2007", on file with the Planning Department, <br />except as modified by the following conditions. Minor changes to the plans may be <br />allowed subject to the approval of the Planning Director if found to be in substantial <br />conformance to the approved Exhibit A. <br />2. The gate as constructed is not approved and shall be re-designed and reconstructed to <br />meet Building Code and Fire Code emergency access requirements. The gate shall be <br />designed with panic hardware to allow unrestricted egress from 122 W. Neal Street at all <br />times but may be secured to prevent ingress onto 122 W. Neal Street so long as the <br />gate is modified to provide a Knox Box or similar mechanism to allow Fire Department <br />emergency access to 122 W. Neal Street and to allow Pleasanton Garbage Service <br />personnel to have access to 122 W. Neal Street for the purpose of moving the dumpster <br />on that property to and from the Pleasanton Station/Railroad Square property for <br />purposes of emptying the dumpster. The design of the gate shall be submitted for the <br />review and approval of the Chief Building Official, the Fire Marshal, and the Planning <br />Director within 30 days of approval of PUD-81-28-5M, and the gate shall be modified <br />according to the approved plans within 30 days of approval by the City. The City shall <br />pay the cost of the gate modifications. <br />3. The owner of the Pleasanton Station/Railroad Square property shall record an easement <br />in favor of the owner of the Hap's Restaurant property granting emergency access from <br />122 W. Neal Street through the gate in the masonry wall referenced in Condition No. 2 <br />leading to the concrete pad in front of the trash enclosure for Pleasanton <br />Station/Railroad Square. The easement shall be subject to the review and approval of <br />the City Attorney and shall be submitted to the City Attorney within 30 days of approval <br />of PUD-81-28-5M. The easement shall not be recorded until the property at 122 W. <br />Neal Street (a) has been striped or otherwise appropriately marked (as determined by <br />the Fire Marshal) to delineate that portion of the property that must be kept free of any <br />obstructions at all times for purposes of emergency access from the building on 122 W. <br />Neal Street to the gate referenced in Condition No. 2 and (b) has had constructed <br />thereon a dumpster and trash enclosure approved by the City. <br />
